Terms of Use

This text is a translation provided for information purposes; in the event of a dispute, the Turkish text shall prevail.

These Terms of Use govern the use of the KaliteGO management system software (the "Service") at kalitego.com, provided by ZincirX Inc. (the "Company", "we") and operated on the Company's behalf by ZincirX Bilişim Teknoloji ve Danışmanlık A.Ş.. By creating an account or using the Service, you accept these terms. If you accept them on behalf of a company, you represent that you are authorized to bind that company.

1. Scope of the service

KaliteGO is a software service that provides document templates for management systems such as ISO 9001, 14001, 27001, 13485, 22301, 27701 and KVKK, AI-tailored document drafts for your company, and record modules such as corrective actions, internal audits, management reviews, risk, training, suppliers, calibration, objectives and a certification calendar.

KaliteGO is not a certification body and does not guarantee certification. Documents produced by the Service, including those prepared with AI, are drafts: it is your responsibility to review them for fit with your company's actual processes, approve them and implement them. The outcome of an audit and certification depends on the assessment of an independent certification body.

2. Accounts and roles

• The person who opens the company account becomes the company's administrator and can invite users to the company. Consultant accounts can access the companies they are responsible for.
• You are responsible for ensuring that the information you provide is accurate and up to date, and for the security of your login credentials and two-factor authentication tools. If you suspect unauthorized use of your account, notify us immediately.
• Persons under 18 may not open an account.

3. Content and data

• The information you enter into the Service and the documents and records you produce with the Service ("Content") belong to you. We process and store the Content solely to provide the Service.
• The Content may include personal data belonging to your employees, suppliers or other individuals (for example, training participants, audit findings). For such data, your company is the data controller; we process this data solely on your instructions and as a data processor in order to provide the Service. It is your responsibility to have the necessary legal basis to process this data and to inform the data subjects.
• When you generate documents with AI, the company information required for generation and the template content are sent to the AI provider (see Privacy Policy and KVKK Privacy Notice). We recommend that you avoid entering unnecessary personal data that would be sent to the AI provider.
• You may not use the Service for unlawful purposes, in a way that infringes the rights of others, or in a manner that endangers the security of the system. You may not bulk-copy the template library and distribute it as another product.

4. Subscription, trial and payment

• The Service is offered as a monthly or annual subscription under the Starter, Professional, Enterprise and Consultant plans. The scope and prices of the plans are set out in the pricing section and in the Preliminary Information Form.
• A 14-day free trial is offered once per company. Card details are requested on the payment page for the trial, but you are not charged during the trial. If you don't cancel before the trial ends, the first-period fee for the plan you selected is automatically charged to your card when the trial ends.
• The subscription renews automatically for the same duration at the end of the period you selected (month or year) until cancelled, and the fee for each period is charged at the start of the period.
• You can cancel your subscription anytime from the "Billing and payment" section on the Subscription page; cancellation takes effect at the end of the paid period and you will not be charged for the next period.
• You can change your plan on the Subscription page. When upgrading, the price difference for the remaining days of the period is charged immediately; when downgrading, the difference is credited to your next invoice.
• Payment in Turkish lira: Turkish lira payments are collected on the ZincirX secure payment page through ZincirX Bilişim Teknoloji ve Danışmanlık A.Ş.'s payment institution Tosla (Akbank); this company is the seller and the issuer of the invoice for these orders. The Turkish lira plan is prepaid: it is paid once for the selected period and does not renew automatically. Prices include VAT.
• Card payments in USD are collected via Stripe in US dollars; taxes shown on the payment page are added to the price. Your card details are processed by Stripe; we do not see or store your card number. Invoices and receipts are issued via Stripe on behalf of ZincirX Inc..
• When your subscription ends, your company returns to trial limits; your records are not deleted, and when you subscribe again you pick up right where you left off.
• The sale is subject to the provisions of the Distance Sales Agreement and the Cancellation and Refund Policy.

5. Service continuity

We take reasonable care to provide the Service without interruptions or errors; however, temporary interruptions may occur due to maintenance, updates, disruptions in third-party services (hosting, payment, AI) or force majeure. We back up your Content regularly; nevertheless, we recommend that you export and keep copies of your important documents.

6. Limitation of liability

To the extent permitted by law, we are not liable for damages arising from the suitability of the documents for your company, audit and certification outcomes, the accuracy of the data you enter, or unauthorized use of your account through means under your control. Cases of intent and gross negligence, and consumers' statutory rights, are reserved. For non-consumer customers, our total liability is limited to the amount you paid us in the 12 months preceding the event giving rise to the damage.

7. Closing your account

You may request closure of your company account at any time. If you seriously breach these terms, we may suspend or close your account. How data is retained and deleted when an account is closed is explained in the Privacy Policy and KVKK Privacy Notice.

8. Changes

We may update these terms and prices. We will notify you of significant changes and price increases by email or through the Service at least 30 days before they take effect; a price increase applies to your existing subscription at the next renewal, and you may cancel before then.

9. Governing law and disputes

These terms are governed by Turkish law. Consumers may apply to the Consumer Arbitration Committee at their place of residence within the monetary limits set annually by the Ministry of Trade under Consumer Protection Law No. 6502, and to the Consumer Courts for disputes exceeding these limits. For disputes with non-consumer customers, the Istanbul (Çağlayan) Courts and Enforcement Offices have jurisdiction.
